Organisational and Business Terms & Conditions

By purchasing a ticket, the Purchaser agrees to the following Organisational Terms:

Tickets

Prior to advance booking, we reserve places for VIP guests, partners and technical bookings in the auditoriums. The visitor is obliged to accept these bookings made by the Organizer. Reserved tickets that have not been collected will be released for sale as last minute tickets 15 minutes before the start of each screening. With full occupancy, places cannot be claimed.

 

Tickets are sold in the order they were received to fill the auditorium capacity.

Advance Booking

Advance booking date Advance sale of tickets will begin on 6th September at 9am.

Before the festival tickets can be purchased online at www.festivalfinale.cz; tickets for selected festival events can be also purchased via the www.goout.cz portal.

 

During the festival tickets can be purchased directly at the Festival Box Offices or online at www.festivalfinale.cz; tickets for selected festival events can be also purchased via the www.goout.cz portal or through partners of the supporting programme.

E-ticket via www.festivalfinale.cz.

The latest purchase time is 3 hours before the start of each screening. The e-ticket holder shall show the e-ticket, either printed on A4 sheet or stored on a mobile device, at the entrance to the film venue.

 

On-line ticket purchase and accreditation is provided via a secure payment system, The Pay. All information about this system, including Terms and Conditions and Return Policy, can be found at www.thepay.cz

 

Purchased tickets cannot be returned or exchanged unless the screening is cancelled or changed by the Festival or the accompanying programme Organizer. The customer is entitled to ticket refund only if the screening is cancelled or not completed due to acts of god and at least 20 minutes of the programme were left unperformed. The entitlement to ticket refund must be claimed during the actual Festival (24-29 September 2021) at the Festival Box Office at the Měšťanská beseda, Kopeckého sady 13, 30100 Pilsen. After the close of the Festival you can write to: ticketing-ZAVINOVADLO:festivalfinale.cz. Ticket refund is made the same way it was paid.

 

Falsifying tickets is not permitted and is punishable by law.

Discounts

The Organizer provides a discount on admission to holders of disability ZTP or ZTP/P cards (50%) and persons accompanying the ZTP/P cardholders (the price is always CZK 0). The card must be submitted together with the discounted ticket at the entrance to the film venue.

 

Individual discounts cannot be added or combined.

Access to Festival Events

A visitor to a screening must respect the instructions of the Organizers and members of the fire patrol.

 

It is not allowed to bring tape recorders, film cameras, cameras or camcorders to Festival screening venues. It is strictly prohibited to make audio, film, photo or video recordings, even for private use.

 

It is forbidden to bring flammable materials into the building and handle open fire.

 

It is forbidden to walk or bring pets to the auditorium.

 

The visitor will not be allowed to the festival screenings under the influence of psychotropic substances or in a visibly drunken state.

 

Due to the character of the event and the length of programmes, the Organizer recommends admission to children aged 6+.

 

A visitor that disturbs a programme with loud speaking or inappropriate behaviour may be removed from the auditorium by the Organizer without refund.

 

During the show, the use of mobile phones and smoking is prohibited.

 

We ask visitors to respect other festival visitors and behave with tact.

 

Entrance to the auditorium is allowed before the start of screening by the Organizer at the entrance.

 

We recommend taking your place early, no later than 10 minutes before the start of the event. After the start of the event, access to the auditorium will not be allowed before the official break (if break is announced in the programme).

General Provisions

The visitor expressly agrees that photographs, films or video recordings with their person taken during or in connection with the event may be used by the Organizer in the usual material, local and time scope in fulfilling their legitimate interest. The rights to use picture recordings under the reporting and art licenses are not affected.

 

The Festival Organizer reserves the right to change the casting of a concert or performance or the venue. Changes to the programme are reserved.

Processing of Personal Data

The Organizer (Film Servis Plzeň s.r.o.) processes personal data in accordance with the EU law, in particular European Parliament and Council Regulation (EU) No. 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, as amended (hereinafter the ‘Regulation’).

The Organizer (i.e. vendor of tickets and accreditations for the Finále Plzeň Film Festival) is Film Servis Plzeň s.r.o., Mánesova 1915/80 Plzeň, company ID: 02748053, Tax ID: CZ02748053. The company is a VAT payer.

Terms of Use of www.festivalfinale.cz

1. Introductory Provisions

The owner and operator of the internet domain www.festivalfinale.cz is Film Servis Plzeň s.r.o., Mánesova 1915/80 301 00 Plzeň, company ID: 027 48 053, registered on 7 March 2014 at the Plzeň Regional Court under file number C 29530 (hereinafter as the ‘Operator’). By using the www.festivalfinale.com website, the User undertakes to observe the Terms of Use of the www.festivalfinale.cz Website (hereinafter the ‘Terms of Use’) as well as all valid and generally-binding legal regulations of the Czech Republic. Users also undertake not to jeopardize the good reputation of the Finále Plzeň Film Festival, Film Servis Plzeň s.r.o. company and their website.

 

2. Copyright and Licensing Laws

The www.festivalfinale.cz website as a whole is authorial work in accordance with Section 2 of Act No. 121/2000 Coll., the Copyright Act, as amended. The Operator has all license rights under the Copyright Act to the content of the website as a whole. The Operator is also entitled by the licence to use individual elements of the website, in particular photographs, design, graphics, logos, texts, sounds, etc. Any part of the www.festivalfinale.cz website content may be used without the Operator’s consent only for private purposes. It is prohibited to publish, copy, distribute and use the contents of www.festivalfinale.cz for commercial purposes without the prior express and written consent of the Operator. In the case of copyright breach, the Operator shall be entitled to damages and any other claims guaranteed by the Rules of Administrative Procedure of the Czech Republic.

 

3. How to Use the Website

The User acknowledges and agrees to use www.festivalfinale.cz while the following is prohibited: to interfere with the safety, technical nature and content of the www.festivalfinale.cz website or otherwise misuse it, to interfere with the use of this site by other Users, to use this site to send unsolicited messages (spam), chain mail, to send virus-containing messages or any other malicious or damaging programmes to this site, to attempt to gain access to those parts of the www.festivalfinale.cz website that are excluded from public use, especially the source code etc., to disseminate on this website any news or material that violate the valid generally-binding legal regulations of the Czech Republic.

When a User visits www.festivalfinale.cz, the Operator processes data about the User's behaviour on the website on the basis of their legitimate interest (i.e. without the User’s consent) in order to:

IP address of the User's device (the address of the User's device through which the User communicates with other devices on the internet);

For these purposes, the Operator uses personal details for 14 months. The User has the right to raise an objection against this processing.

4. Limitation of the Operator’s Liability

  1. The provisions of this article do not apply to legal relationships arising from the sale of tickets via the www.festivalfinale.cz website, the modification of which is included in the Ticket Sale Terms & Conditions.
  2. The content of the www.festivalfinale.cz website is only informative and non-binding. The Operator is not liable for the accuracy and completeness of information on this website. The publication of any data and information on this site, except for these Terms of Use, does not represent a legal act aiming to establish a legal relationship between the Operator and the User.
  3. The Operator is not liable for any possible damages incurred by the User as a result of following the content of the www.festivalfinale.cz website and using the site.
  4. The Operator may at any time, without prior notice, make any changes to the information and content of the www.festivalfinale.cz website.
  5. The Operator does not bear any responsibility for advertising, or any other form of promotion by any third party via the www.festivalfinale.cz website.
  6. The Operator does not bear any responsibility for the content of third party websites, which can be accessed via the www.festivalfinale.cz website.

5. Competitions

The Operator organizes competitions on the www.festivalfinale.cz website, which can be attended by a natural person fully competent to legal acts. The Operator reserves the right to shorten, suspend or cancel a competition or change its rules.

 

Anyone who accepts the rules of the competition will be eligible to participate in the competition if they also fulfil the following conditions: Answering the competition question for a particular competition via SMS, email, answer form or other alternative. The participant shall send the answer to the competition question in a manner and according to guidance given in the competition instructions. The participant shall include in the reply also their name, surname and telephone or email contact details unless otherwise specified by the competition instructions. The competition participant consents to their name and surname being published within the results of the competition listed on the Organizer's website, or in a periodical issued by the Organizer.

 

The competition starts on the day it is announced by the Organizer on its website and ends on the day specified in the competition instruction. The Organizer will not include in the competition SMS messages, emails, reply forms and other replies received after that date. The competition results will be announced no later than one month after the end of the competition. Competition prizes will be awarded to the number of competitors specified in the competition instructions, according to the rules specified therein. The Organizer of the competition reserves the right to check the fulfilment of conditions for the participation in the competition and to assess the entitlement to the prize. The competition Organizer reserves the right to make final decisions at their sole discretion in disputed cases. Prizes are not legally enforceable. The Organizer is not responsible for any technical defects in electronic communication in the course of the competition and shall not be liable in the event of difficulties in participating in the competition as a result of any technical failure or congestion of network traffic.

 

Prizes are given to the winners by the Organizer or by the company listed in the competition instructions. The winners accept the prizes at their own risk and by doing so the winner assumes full responsibility for any damage that may be caused to them or third parties by using the prize. The Organizer of the competition is in no way responsible for any damages caused to the winners or third parties by the prizes or any damages incurred in connection with the use of these prizes.

 

6. Final Provisions

Should any of the provisions of these Terms of Use prove to be invalid or ineffective, this shall not affect the validity and effectiveness of any other provisions of these Terms of Use that are separable from invalid or ineffective provisions.

 

The Operator reserves the right to change the text of these Terms of Use at any time.

 

All provisions of these Business Terms and the contractual relationship between the Organizer, the Purchaser and Film Servis Plzeň s.r.o. are governed by Czech law.

 

These Terms of Use are valid and effective on the day they are published on the www.festivalfinale.cz website.

Terms & Conditions for Ticket Sale at the Finále Plzeň Film Festival

1. Introductory Provisions

These Business Terms and Conditions and the Return Policy (hereinafter the ‘Business Terms’) govern the rights and duties of the company Film Servis Plzeň s.r.o., Mánesova 1915/80 301 00 Plzeň, company’s ID: 027 48 053, registered on 7 March 2014 at the Plzeň Regional Court under file number C 29530 (hereinafter as ‘FSP’), in the sale of tickets for the Finále Plzeň Film Festival (hereinafter the ‘Finále Plzeň’).

By purchasing the tickets, the Purchaser also confirms that they have read these Business Terms.

 

The FSP sells tickets via the www.festivalfinale.cz website and through its sales points and sales points of the contractual partners.

 

2. Subject of the Contract

The Subject of the Contract is the FSP's obligation to deliver tickets to the Purchaser for the Finále Plzeň Film Festival in its own name and the Purchaser's commitment to pay for the tickets. The Contract is concluded at the moment of admission payment by the Purchaser.

 

The FSP undertakes to supply the Purchaser with tickets without undue delay after they paid the ticket price; in case of internet purchase the tickets will be delivered electronically to the e-mail address specified by the Purchaser, and in case of purchase in another way within the distribution network (at the Festival Box Office or from the FSP’s business partner) the tickets will be delivered to the Purchaser immediately after payment by the officer selling the tickets to the Purchaser.

Purchasers are not entitled to ticket delivery before the ticket price is paid in full.

 

3. Rights and Obligations of the Contractual Parties

Purchasing a ticket for Finále Plzeň creates a legal relationship between the Purchaser and the FSP.

By purchasing the ticket, the Purchaser undertakes to observe the rules set by the FSP.

By purchasing the ticket, the Purchaser also undertakes to conform to the Operational and Visiting Rules for each venue of the Finále Plzeň Film Festival.

The FSP undertakes to organize the Finále Plzeň Film Festival.

The FSP reserves the right to change its programme, dates and venue.

By purchasing the ticket, the Purchaser acknowledges this FSP’s right.

 

4. How to Buy Tickets and Payment Terms

The ticket price is shown individually for each event. In the event of a ticket purchase via www.festivalfinale.cz, the payment for the ticket is possible via the payment system The Pay.

The FSP is not responsible for any potential cost incurred by the Purchaser associated with the purchase of a ticket resulting from the Purchaser’s contractual relationship with the bank that issued the payment card to the Purchaser or that holds the Purchaser’s bank account through which the Purchaser paid for the ticket.

Upon agreement with a FSP officer responsible for ticket sales, tickets may be sent by post, but not by cash on delivery.

 

5. Withdrawal from the Contract

In accordance with the provisions of Section 1837(j) of Act No. 89/2012 Coll., the Civil Code, as amended, the Purchaser has the right to withdraw from the Contract made between the Purchaser and the FSP in accordance with Section 1829 of the Civil Code (withdrawal from the Contract within 14 days without giving a reason) because it is a contract for the use of leisure time and the performance is provided by the business, in this case the FSP, within a specified time.

 

6. Returns Policy

All returns of tickets purchased from the FSP via the sales network are governed by these Business Terms and Returns Policy described in this article.

The Purchaser is entitled to ticket price refund only in the cases listed below and under the terms and conditions set forth below.

 

The customer is entitled to ticket refund only if the screening is cancelled or not completed due to acts of god and at least 20 minutes of the programme were left unperformed, or for a reason set forth in paragraph 5 below.

 

The Purchaser is not entitled to exchange the ticket. In the event of damage, destruction, loss, theft or other devaluation of the ticket, it will not be replaced with a new ticket and the Purchaser will not be offered a substitution, or refunded the ticket price.

 

The FSP assumes no responsibility for not delivering the ticket to the Purchaser for reasons on the Purchaser’s side, in particular because the ticket cannot be delivered to the Purchaser’s e-mail address they provided (e.g. full mailbox, spam filtering, etc.).

 

If the Purchaser does not receive the ticket within one hour after the payment of the ticket price, they shall immediately, but not later than within 24 hours from the expiration of the aforementioned period for ticket delivery, contact the FSP and notify them that they have not received the paid-for ticket. For these purposes, the Purchaser is required to give the FSP the name and contact e-mail or identification data they provided when purchasing the ticket. If the FSP finds out that the ticket has not actually been delivered to the Purchaser and it is not the case referred to in paragraph 4 of this Returns Policy, and the Buyer has notified the FSP that the ticket was not delivered within the above-mentioned time limit and manner, they shall proceed as set out in this paragraph.

 

The FSP undertakes to send the Purchaser the ticket by e-mail to the e-mail address provided by the Purchaser within 24 hours, but no later than 1 hour before the event.

 

If the event has already taken place, the FSP undertakes to refund the ticket price paid to the Purchaser within 14 days of the date of the Purchaser’s claim.

 

The entitlement to ticket refund must be claimed during the actual Festival (24-29 September 2021) at the Festival’s Box Office at the Měšťanská beseda, Kopeckého sady 13, 30100 Pilsen. After the close of the Festival, you can write to: ticketing-ZAVINOVADLO:festivalfinale.cz. Ticket refund is made the same way it was paid.

 

7. Out-of-court Dispute Resolution

In the event of a consumer dispute between the FSP and the Customer in connection with the purchase of a ticket to the Finále Plzeň Film Festival, which cannot be settled by mutual agreement between the Customer and the FSP, the Customer may submit a motion for an out-of-court settlement of such dispute to a designated authority for extra-judicial settlement of consumer disputes, which is the Czech Trade Inspection Authority (CTIA), the Central Inspectorate - ADR Section, Štěpánská 15, 120 00 Praha 2, e-mail: adr-ZAVINOVADLO:coi.cz, web: http://adr.coi.cz. The Customer can also use the online dispute resolution platform set up by the European Commission on http://ec.europa.eu/consumers/odr/.

 

8. Processing of Personal Data During Sale

The Organizer (Film Servis Plzeň s.r.o) processes personal data in accordance with the EU law, in particular European Parliament and Council Regulation (EU) No. 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, as amended (hereinafter the ‘Regulation’).

9. Final Provisions

Should any of the provisions of these Terms and Conditions prove to be invalid or ineffective, this shall not affect the validity and effectiveness of any other provision of these Business Terms that are severable from an invalid or ineffective provision.

 

The Film Servis Plzeň s.r.o. is authorized to change these Business Terms at any time.

All provisions of these Business Terms and the contractual relationship between the FSP and the Purchaser are governed by Czech law.

 

All disputes arising from the sale of tickets for the Finále Plzeň Film Festival will be dealt with by general courts of the Czech Republic, unless they are settled out of court.
